Ante Up Guy - Stallion Service Contract
2012 breeding fee $750.00 LFG
Foals will be eligible for:
JJ Classic, MBRA, VGBRA, Hawki futurities, and the BRIF program
This contract for the 2012 breeding season and is made and entered into on this date: _______________, between Howard and Cathy Dickey and ________________________ .
Mare Owner agrees to breed the mare _____________________________________, Reg. No. _________________, to stallion Ante Up Guy - registration # 4496724 , subject to the following conditions:
1. A booking Fee of ____________ of the above fee is payable with this contract and the balance of ____________ plus all unpaid expenses will be payable upon receipt of an invoice or when the mares leaves the farm, whichever is first. The Breeder requires 48 hours advance notice when the Mare Owner wish to remove his/her mares (s) from the farm. This will allow us sufficient time to prepare the required health papers and final statement so the Owner my settle his account. The booking fee is non-refundable.
2. The mare shall be in healthy and sound breeding condition, free from infectious, contagious or transmissible disease. A current negative Coggins Test, photostat copy of registration paper (both sides), veterinarian’s health certificate, plus a health worming and immunization record must accompany mare: if they do not, Breeder’s veterinarian may examine and/or test mare at Mare Owner’s expense. Stallion Owners reserves the right to refuse mare if not in proper condition.
3. Stallion Owners will exercise judgment in care and supervision of mare and/or foal. Stallion Owner’s veterinarian may examine mare for normal breeding conditions and, if necessary, will administer medical care as deemed necessary for the health and safety of the mare and/or foal. All veterinarian and farrier expenses will be paid by Mare Owner.
4. Mares that are not halter broken will not be accepted.
5. Stallion Owners agrees to diligently try to settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Stallion Owners blameless. Mare Owner agrees to give Stallion Owners ample opportunity to settle mare.
6. It is agreed that should the stallion die, or become unfit for service this breeding contract shall be null and void. Any breeding fee which has been paid will be refunded.
7. This contract contains a “Live Foal Guarantee.” A live foal is described as a newborn foal which stands and nurses without assistance. If foal is born dead, there are return privileges only if Stallion Owners is notified within 3 days and receives a veterinarian’s statement confirming death. LFG is only good for 2 years of this contract date!
8. It is agreed that should the mare miscarry, abort or prove barren after leaving Stallion Owner’s premises, Mare Owner has the privilege to return her for breeding during the breeding season 2013.
9. A “Breeder’s Certificate” will be issued for the foal, conceived by this mating, when stallion fee and all other expenses have been paid in full; and when mare has produced a live foal by this mating.
10. Both partiers agree that Howard and Cathy Dickey, the Stallion Owners and any person associated with Stallion Owners are not liable for death, sickness and/or accident caused to the mare and/or foal; and, that the Mare Owner is not liable for death, sickness, and/or accident caused to stallion.
11. This contract is not transferable or assignable. This contract is entered into the State of Minnesota and will be interpreted and enforced under the laws of that state.
